Resident Responsibilities

The following are drawn from the By Laws and City ordinances governing the common areas and use of facilities for the Cottonwoods Condominium complex.

Rules and Resident Responsibilities

 

Overview

 

The Cottonwood Condominiums are comprised of 102 Units that share many common elements.  We are neighbors in close proximity to each other and as such, we share responsibility for how our neighborhood remains safe, attractive and enjoyable for all of our residents. Our By-Laws and Declarations identify several specific rules and resident responsibilities that help to clarify how to ensure these goals are met. What follows summarizes the most relevant rules, how to report concerns, and the consequences for non-compliance. Each section provides a page and item number where these can be found in the Declarations. On behalf of our entire community, please carefully review and comply with these rules and resident responsibilities.

 

Use of Condominium:

Cottonwood Condominiums may be used for residential purposes only.

 

Restrictions: p.9, B-1

1) Leasing is permitted by an owner for a period of 6 months or longer. No property may be leased for less than 6 months.

2) Alterations or modifications to the exterior of the unit requires approval by the Board (p9, B-2).

3) Activities:

  • Commercial/business activity is prohibited.
  • Improper, unlawful, immoral activity is prohibited.
  • Loud noises – especially after 10 PM – are prohibited.
  • Any activity or possession that would increase insurance is prohibited.

4) Pets p10, B-4

  • The Board may adopt and enforce rules and regulations governing the type or types of permitted and non-permitted animals, their conduct and the manner and location of their housing.  The Association can, without liability, remove or cause to be removed, any non-permitted animals.
  • Permission to keep pets is subject to noise and nuisance restrictions.
  • Pets may not be housed outdoors including tethering and dog runs.
  • Pets may not be permitted outside unleashed or unattended by residents. Residents are strongly encouraged to leash their pets within the community. Leashing pets is a city ordinance.
  • Pet’s excrements must be promptly cleaned by their owners.
  • Owners shall indemnify and hold harmless the Association and all other unit owners from loss of a pet.

  • General or common elements may not be used for storage of supplies, materials, personal property, trash or refuse of any kind.
  • Unsightly or unsanitary conditions are not permitted.
  • All cooking facilities and equipment are expressly prohibited in any general or limited common areas except as expressly permitted by the Board in designated areas.
  • The use of gas BBQ’s and firepits are only permitted away from the buildings. Woodburning or charcoal BBQ’s and firepits ate not permitted.
  • Trash receptacles are not permitted anywhere except in the provided enclosures.
  • Activity and objects that are detrimental to the appearance of the condominiums are not permitted.

Signs or other advertising devices of any kind are not permitted.

 

Parking p11. B-7

  • Parking is described under Limited Common Elements on page 8 of The Declarations stating: The covered parking spaces adjacent to each Condominium Building are numbered to coincide with the Unit # for each condominium. One (1) such covered parking space shall be assigned to each unit.
  • Only one unassigned (open) parking space per unit is permitted.
  • The following may NOT be parked in assigned or in open parking spaces: non-operational vehicles; mobile homes; recreational vehicles; boats; ATV’s; junk vehicles; unlicensed or abandoned vehicles.

Association’s Right to Access

The Association (via the Board) has the right to access each unit for the purpose of repairs, etc., given notice and scheduled during reasonable hours.

 

The above Rules and Resident responsibilities are included in The Declarations. They do not represent the full list of regulations.

 

Occasionally, the Board may adopt additional rules to address changing needs.  We will inform residents of any new rules via the Cottonwoods Community website and at our annual meeting with owners. All residents are encouraged to review all current and updated rules to remain informed and so we can operate as a cooperative community.

 

We also encourage all residents to become informed about and to follow Missoula County Ordinances when applicable to issues concerning pets, safety, noise, junk, etc. The link to these ordinances can be found at _________.

 

Complaints re: Violations of Rules and Resident Responsibilities

For minor concerns, please attempt to first resolve them directly with your neighbor.  Please report any unresolved concerns re: failure to comply with the Rules in writing via email to MT Properties at: [email protected]. Please include documentation including names, location, dates, description of the concern, and photos if possible.

 

All reported concerns re: violations of the Rules and Resident Responsibilities will be reported to the Board which will:

  • Notify the identified resident of the complaint by phone and by email.
  • Follow up within 3 days to ensure compliance/resolution of the concern/violation.
  • If the concern/violation continues or is repeated, the Board may impose a fine of, but not limited to, $100.00.
  • Said fines will continue to accrue until the resident is in compliance with the required resolution.
